Please read these Terms of Service ("Terms") carefully before using our website at toms-junk.com, submitting a service request, or engaging Tom's Junk Service to perform any work. By taking any of these actions, you ("you" or "customer") agree to be legally bound by these Terms.
Tom's Junk Service is owned and operated by Thomas Dove as a sole proprietor doing business as Tom's Junk Service, based in Frederick, Maryland ("Company," "we," "us," or "our").
If you do not agree to these Terms, please do not use our website or services.

We reserve the right to decline any job at our sole discretion, including but not limited to jobs that present safety hazards, require equipment or expertise beyond our capacity, or involve prohibited materials as described below.
📱 Tom's Junk Service operates an SMS text messaging program to communicate with customers. Consent to receive text messages is always optional and is never required to request or receive our services.
By submitting our online estimate form and checking one or both of the optional, non-pre-checked SMS consent checkboxes, you expressly consent to receive text messages from Thomas Dove operating as Tom's Junk Service at the mobile number you provided. We operate two separate SMS programs:
Opting into this program means you agree to receive recurring automated SMS messages related to your active service requests, including appointment confirmations, scheduling reminders, crew arrival notifications, estimate follow-ups, job completion notifications, and post-service review requests. These messages are transactional and directly related to services you requested.
Opting into this separate program means you agree to receive promotional SMS messages from Tom's Junk Service, including seasonal offers, service discounts, referral promotions, and periodic service reminder campaigns throughout the year. This program is entirely separate from service messages, and opting out of one does not affect the other.
Tom's Junk Service uses third-party mobile carriers and messaging platforms to deliver text messages. Mobile carriers — including but not limited to AT&T, Verizon, T-Mobile, US Cellular, and others — are not liable for delayed, failed, or undelivered messages. Message delivery is subject to each carrier's network availability, coverage, and terms of service. We are not responsible for issues arising from carrier network outages or technical problems outside of our control.

Estimates provided through our website form, by phone, or by text are preliminary in nature and are based on the information you provide to us. A final, confirmed price is provided on-site by our crew before any work begins. You are under no obligation to proceed with the service after receiving an on-site estimate.
Final pricing is determined by several factors, including total load volume, type of materials being removed, difficulty of access, labor required, travel distance, and any applicable dump or disposal fees. Heavy or specialty materials such as concrete, tile, dirt, and large appliances may affect the final price. We will always communicate clearly and transparently about cost before we start any work.
Minimum job fee: $150. No job will be priced below this amount regardless of load size.
For the safety of our crew and compliance with applicable waste disposal regulations, we are unable to remove, haul, or dispose of the following items under any circumstances:
If any prohibited items are discovered after work has already begun, we reserve the right to stop work immediately. In this case, you will be charged for any labor and time already expended, and you will be responsible for the separate disposal of prohibited items.
Payment is due in full upon completion of the agreed-upon services. We currently accept cash and all major credit and debit cards. For standard junk removal jobs, we do not require any deposit upfront. For larger, multi-day, or specialty projects, we may request a reasonable deposit at our discretion prior to scheduling.
By providing payment information at the time of payment, you authorize Tom's Junk Service to charge the total agreed-upon amount for services rendered. We never store full credit card numbers in our systems.
We understand that plans change, and we're happy to work with you on scheduling. If you need to cancel or reschedule, please notify us as early as possible. Cancellations or no-shows with less than 2 hours' notice on the scheduled day of service may be subject to a $50 cancellation fee to cover the cost of crew time and fuel already committed to your appointment. We will always try to be reasonable and work with you on a case-by-case basis.
By requesting and receiving our services, you represent, warrant, and agree that:
Tom's Junk Service is not responsible for any items removed in error that were not clearly excluded or protected prior to the commencement of work. Please clearly communicate anything that should not be touched before our crew starts.
Our crew takes care to protect your property during every job. In the unlikely event that our crew directly causes damage to your property during service, please notify us within 24 hours of the job's completion so we can address the issue promptly and fairly. We are not liable for damage attributable to pre-existing conditions, structural issues, or damage caused by the state of the items being removed (for example, a leaking appliance or a crumbling structure). We are also not liable for damage that occurs in areas where we were not given warning about fragile, hidden, or delicate items or infrastructure.
You must be at least 18 years of age to use our website, submit a service inquiry, enter into a service agreement, or consent to SMS communications from Tom's Junk Service. By using our site or services, you represent and warrant that you are 18 or older. We do not knowingly provide services to or collect information from individuals under the age of 18. If we discover that a person under 18 has submitted information to us, we will delete it promptly.
Tom's Junk Service is committed to responsible disposal practices. Whenever items are in reusable, working, or donatable condition, we make a genuine good-faith effort to deliver them to local donation centers, charities, or recycling facilities before sending anything to a landfill. We do not guarantee the donation or recycling of any specific item, as acceptance is ultimately at the discretion of the receiving organization. We will never misrepresent our disposal practices to you.
To the fullest extent permitted by applicable law, Tom's Junk Service and Thomas Dove shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind arising out of or related to your use of our services, our website, or these Terms — even if we have been advised of the possibility of such damages. In all cases, our total liability to you for any claim arising from services we performed shall not exceed the total dollar amount you paid us for those specific services.
You agree to defend, indemnify, and hold harmless Thomas Dove and Tom's Junk Service from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services or website; (b) your breach of any provision of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of the rights of any third party.
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles. Any legal disputes, actions, or proceedings arising out of or related to these Terms or our services shall be brought exclusively in the state or federal courts located in Frederick County, Maryland. You hereby consent to the personal jurisdiction of those courts.
Before initiating any formal legal action, we encourage you to contact us directly at (240) 549-2926 to attempt to resolve any dispute informally. Most issues can be resolved quickly with a direct conversation.
We may revise and update these Terms of Service from time to time at our discretion. The "Last updated" date at the top of this page will always reflect when the most recent changes were made. We encourage you to review this page periodically. Continued use of our website or services after any changes are posted constitutes your acceptance of the revised Terms. If we make significant changes, we may notify active customers directly.
